By downloading, installing, or using the Brelti mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Brelti ("we," "us," or "our"). We may update these Terms from time to time, and your continued use of the App after any changes constitutes acceptance of the new Terms.

2. Description of Service

Brelti is a healthcare management and care coordination platform that helps individuals and caregivers:

Organize and store medical documents and health information
Manage appointments, medications, and care schedules
Find and research healthcare providers
Coordinate care among family members and caregivers
Receive appointment reminders and notifications
Use AI-powered assistance for healthcare-related questions

Important: Brelti is not a medical device and does not provide medical advice, diagnosis, or treatment. The App is designed to help you organize and manage healthcare information, not to replace professional medical care.

3. Eligibility

To use Brelti, you must:

Be at least 18 years of age, or the age of majority in your jurisdiction
Have the legal capacity to enter into a binding agreement
Not be prohibited from using the App under applicable laws

If you are using Brelti on behalf of someone else (such as a family member or care recipient), you represent that you have the legal authority to act on their behalf and accept these Terms for them.

4. Account Registration

To use certain features of the App, you must create an account. When creating an account, you agree to:

Provide accurate, current, and complete information
Maintain and promptly update your account information
Keep your login credentials secure and confidential
Notify us immediately of any unauthorized access to your account
Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that contain false or misleading information, or that violate these Terms.

5. Subscription and Payments

Free Features

Brelti offers certain features at no cost. We may modify the features available for free at any time.

Premium Subscription

Some features require a paid subscription ("Premium"). By purchasing a Premium subscription, you agree to:

Pay the subscription fees as displayed in the App at the time of purchase
Automatic renewal of your subscription at the end of each billing period unless you cancel
The payment terms of the app store (Apple App Store or Google Play Store) through which you subscribed

Cancellation and Refunds

You may cancel your subscription at any time through your device's app store settings. Cancellation will take effect at the end of your current billing period. Refunds are handled according to the policies of the Apple App Store or Google Play Store.

Price Changes

We may change subscription prices at any time. Price changes will not affect your current subscription period but will apply to renewals. We will provide notice of price changes in advance.

6. User Content and Data

Your Content

You retain ownership of all content you upload, submit, or store in the App ("User Content"), including documents, notes, photos, and recordings. By using the App, you grant us a limited license to store, process, and display your User Content solely to provide the services to you.

Content Responsibilities

You are solely responsible for:

The accuracy and completeness of your User Content
Ensuring you have the right to upload and share any content
Maintaining backups of important data
Not uploading content that is illegal, harmful, or violates others' rights

Data Privacy

Our collection, use, and protection of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Acceptable Use

When using Brelti, you agree not to:

Use the App for any illegal purpose or in violation of any laws
Upload content that infringes intellectual property rights or violates privacy
Attempt to gain unauthorized access to our systems or other users' accounts
Interfere with or disrupt the App's operation or security
Use automated means (bots, scrapers) to access the App without permission
Reverse engineer, decompile, or attempt to extract the source code of the App
Use the App to transmit malware, viruses, or harmful code
Impersonate any person or entity or misrepresent your affiliation
Use the App to harass, abuse, or harm others
Sell, resell, or commercially exploit the App without our permission

Brelti is not a substitute for professional medical advice, diagnosis, or treatment.

The App does not provide medical advice or recommendations
Healthcare provider search results are for informational purposes only and do not constitute endorsements
AI-generated responses are for general information and should not be relied upon for medical decisions
Always consult qualified healthcare professionals for medical concerns
In case of emergency, call 911 or your local emergency services immediately

We are not responsible for any health-related decisions you make based on information in the App. You are responsible for verifying the accuracy of any healthcare provider information and for your interactions with healthcare providers.

9. AI Features

Brelti includes AI-powered features to help you organize and search your health information. Regarding these features:

AI responses are generated automatically and may contain errors or inaccuracies
AI features are designed to assist with information organization, not to provide medical advice
We do not guarantee the accuracy, completeness, or reliability of AI-generated content
You should independently verify any important information provided by AI features

10. Intellectual Property

Our Property

The App, including its design, features, content, trademarks, and underlying technology, is owned by Brelti and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our written permission.

Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes in accordance with these Terms.

Feedback

If you provide us with feedback, suggestions, or ideas about the App, you grant us the right to use that feedback without compensation or attribution to you.

11. Third-Party Services

The App may integrate with or link to third-party services, including:

Healthcare provider databases and directories
Calendar applications on your device
Payment processors (Apple App Store, Google Play Store)
Authentication services (Google Sign-In)

Your use of third-party services is subject to their own terms and privacy policies. We are not responsible for the content, accuracy, or practices of third-party services.

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

We do not warrant that:

The App will be uninterrupted, error-free, or secure
Any errors or defects will be corrected
The App will meet your specific requirements
Healthcare provider information is accurate, complete, or current
Your data will never be lost or corrupted

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRELTI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of profits, data, or goodwill
Service interruption or computer damage
Personal injury or property damage resulting from your use of the App
Any health-related outcomes or medical decisions
Unauthorized access to or alteration of your data

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

14. Indemnification

You agree to indemnify, defend, and hold harmless Brelti and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your use of the App
Your violation of these Terms
Your violation of any rights of another person or entity
Your User Content

15. Termination

By You

You may stop using the App at any time. To delete your account and data, contact us at info@brelti.com.

By Us

We may suspend or terminate your access to the App at any time, with or without cause or notice, including if we believe you have violated these Terms. Upon termination:

Your license to use the App is immediately revoked
We may delete your account and User Content
You remain liable for any obligations incurred before termination
Sections that by their nature should survive will remain in effect

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration administered by the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property violations or unauthorized access.

Class Action Waiver: You agree that any disputes will be resolved on an individual basis and not as part of any class, consolidated, or representative action.

17. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last Updated" date. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.

If you do not agree with the modified Terms, you must stop using the App and may request deletion of your account.

18. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Brelti regarding the App.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce it in the future.

Assignment

You may not assign or transfer these Terms or your rights under them. We may assign our rights and obligations without restriction.
